Championing excellence in public education through training, advocacy and service for local school boards

Legal Consultation

Among ASBA’s most popular services is legal consultation for member districts. These services are a supplement to the guidance a school district may receive from its school board attorney or other local counsel.

The association has a lawyer on staff who is available to answer members’ questions about school laws and related matters. Another attorney serves as general counsel for ASBA and can be hired by school boards for litigation purposes. Both lawyers have strong backgrounds in school law. They often conduct ASBA seminars on school and board legal matters and are well qualified to answer your questions. When ASBA’s attorneys assist in school matters, the client is the local school board.

Some frequently asked questions relate to:

  • Process of appointing a board member to fill a vacant position
  • Employee discipline process, including suspension and termination
  • Sexual misconduct investigation and documentation
  • Freedom of Information issues
  • Millage elections

ASBA-member boards who need legal consultation should contact ASBA at 501.372.1415.
